Terms of service

These Terms apply to your use of www.primemart-hk.com (the “Site”), operated by PRIME GROUP (61075458-002-03-26-9), a business registered in Hong Kong. By placing an order, you agree to these Terms.

1. Eligibility

You may place an order only if you are at least 18 years old or have the consent of your legal guardian. Orders containing alcohol may only be placed and received by persons aged 18 or over.

2. Products and availability

All products are subject to availability. Product images are for reference only. Manufacturers may change packaging, branding or pack size frequently, so the appearance of the product received may differ from the photograph.

We make reasonable efforts to keep ingredient and allergen information accurate, but the information on the packaging of the product you receive is the final authority. If you have a food allergy or intolerance, you must check the physical label before consumption. Some imported products may be labelled only in Korean.

3. Prices and payment

All prices are in Hong Kong dollars (HKD) and include any duties payable by us. Delivery charges are calculated at checkout.

We reserve the right to correct pricing errors. If an incorrect price is displayed, we will contact you before dispatch, and you may proceed at the corrected price or change to another product of the same value.

Payment is taken when the order is placed. We accept payment by FPS transfer only.

4. Weight and quantity variations

Stated weights for fresh and weight-based products are approximate. Actual weight may vary by up to 10% from the stated weight. We will contact you before dispatch if the difference is substantial.

5. Substitutions

We will not substitute another product without your consent. If an item is found to be out of stock after you order, we will contact you and help you substitute a similar product.

6. Accounts

You are responsible for keeping your account password secure and for all activity under your account. Notify us immediately if you suspect unauthorised use.

7. Intellectual property

The Site and its content and layout, together with the PRIME mart name and logo, are owned by us or our licensors and may not be reproduced without written permission. Product photographs, brand names and trademarks belong to their respective owners.

8. Prohibited conduct

You agree not to use the Site for unlawful purposes, place fraudulent orders, systematically collect or reproduce content, or interfere with operation of the Site.

9. Limitation of liability

To the fullest extent permitted by law, our total liability in connection with an individual order is limited to the amount paid for that order. We are not liable for indirect or consequential loss. Nothing in these Terms limits your statutory rights under Hong Kong law, our liability for death or personal injury caused by our negligence, or liability for fraud.

10. Force majeure

We are not liable for delay or non-performance caused by circumstances beyond our reasonable control, including delivery service disruption, typhoons and Black Rainstorm Warnings, customs delays or supply interruption.

Typhoons and rainstorms: Delivery is suspended while Typhoon Signal No. 8 or above, or a Black Rainstorm Warning, is in force. Affected orders will be moved to the next available delivery day.

11. Changes to these Terms

We may update these Terms from time to time. The version published on the Site when you place your order applies to that order.

12. Governing law

These Terms are governed by the laws of the Hong Kong Special Administrative Region. You agree to the non-exclusive jurisdiction of the courts of Hong Kong.
